Encore Terms of Service

1. About the Service

Encore ("Encore", "the App") is an iOS photo-recap app developed by SignalRender Inc. ("we", "us"). Encore reads your photo library on your device, selects stretches worth revisiting — a trip, a dense day, this day last year, a place you never returned to — and plays them back in time with a rhythm. These Terms of Service ("Terms") govern your use of Encore.

By installing or using Encore, you agree to be bound by these Terms.

2. Eligibility

You must be at least 13 years old to use Encore. If you are between 13 and the age of majority in your jurisdiction, you must use it with the consent and supervision of a parent or guardian who accepts these Terms on your behalf.

3. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Encore on Apple devices you own or control. You may not:

  • distribute, sell, resell, rent, sublicense, or commercialize Encore or any part of it;
  • reverse engineer, decompile, disassemble, or attempt to derive source code (except where such restriction is prohibited by applicable law);
  • remove or alter any copyright, trademark, or other proprietary notices;
  • use Encore to violate any law or third-party right.

4. Your Photos Remain Yours

Encore claims no ownership of, and no license to, your photos. It reads your library only to run its analysis and playback on your device. It does not upload, publish, transmit, or share your photos, and it does not delete, modify, or move them.

Selection and playback happen entirely on your device; nothing about your library is transmitted to us.

5. Always-Free Core

Browsing everything Encore has selected from your library, and watching any of it in the app, are free and unlimited. This commitment is part of the product's design, not a promotional offer subject to change without notice to you in-app.

6. Purchases & Billing

Where paid features are offered, they are sold at the price and currency shown on the App Store at the time of purchase. All purchases are handled by Apple via In-App Purchase and are subject to your Apple ID and the Apple Media Services Terms.

Auto-renewal: any subscription renews automatically at the then-current price at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period. You can manage or cancel anytime in Settings → Apple ID → Subscriptions on your iOS device. Uninstalling Encore does not cancel an active subscription.

Refunds are handled by Apple under its refund policy; we do not process payments directly and cannot issue refunds independently.

7. What Encore's Selections Mean

Encore's selections are automated suggestions derived from your library's own metadata and image characteristics. Each is presented with a factual reason (for example, the number of photos taken that day, or that a place appears only once in a given year) that you can check against your library.

Encore makes no claim about the significance of any moment in your life. It may miss things that matter to you and may surface things you would rather not see; Encore is not a judgment about your memories, and you should not treat it as one. You can drop any frame from a stretch, or hide a stretch entirely.

8. Music and Exported Material

Where Encore plays a rhythm or soundtrack, that material is licensed to us for playback within the App only. You may not extract, redistribute, or use it separately from Encore. You remain responsible for ensuring that any material you create using Encore and then share elsewhere complies with the rights of any third parties involved.

9. Intellectual Property

Encore, its name, logo, interface, source code, and all related materials are owned by SignalRender Inc. and protected by copyright and other intellectual property laws. These Terms grant you no rights in them beyond the license in Section 3.

10. Disclaimer of Warranties

Encore is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Encore will be uninterrupted, error-free, or that its selections will match your expectations.

11. Limitation of Liability

To the maximum extent permitted by law, SignalRender Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of Encore. Our total aggregate liability shall not exceed the amount you paid us for Encore in the twelve months preceding the claim.

12. Termination

You may stop using Encore at any time by uninstalling it. We may suspend or terminate your license if you materially breach these Terms.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest revision; material changes will be announced via in-app notice. Continued use after a change constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which SignalRender Inc. is established, without regard to conflict-of-law principles.
