1. Acceptance of Terms
By downloading or using Rushes (the "App"), you agree to these Terms of Service. If you do not agree, please do not use the App.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Rushes on Apple devices you own or control, in accordance with Apple's App Store Terms of Service and these Terms. You may not copy, modify, reverse-engineer, or redistribute the App except as permitted by law.
3. Rushes Pro: Subscriptions and Purchases
Recording, keeping and exporting your own clips, and your daily film, are free and will stay free. Rushes Pro adds month films and is available as:
- an auto-renewing subscription, billed yearly or monthly. The yearly plan may include a free trial for eligible new subscribers; any unused part of a free trial ends when you buy a subscription.
- a lifetime one-time purchase, which does not renew and has nothing to cancel.
Payment is charged to your Apple ID when you confirm the purchase. A subscription renews automatically at the same price and period unless you cancel it at least 24 hours before the end of the current period, and your account is charged for the renewal within the 24 hours before the period ends. You can manage or cancel a subscription in your App Store account settings at any time; cancelling stops the next renewal, and Pro stays on until the end of the period you paid for. All purchases are processed by Apple; billing, refunds and receipts are handled by Apple under the App Store Terms. You can restore a purchase on a new device with "Restore Purchases" on the Pro screen.
4. Your Clips
Your clips, films and captions belong to you. Rushes keeps them on your device and does not upload them, so we have no copy to restore if your device is lost, reset or the App is deleted. Keep your device backed up, or use the App's export options, for anything you want to keep.
5. Recording Other People
You are responsible for what you record and share. Respect the privacy of the people around you and follow the laws that apply where you record, including any rules about recording others or obtaining their consent.
6. Acceptable Use
You agree to use Rushes only for lawful, personal purposes. You will not use the App in any way that could damage, disable, or impair it, or interfere with any other party's use.
7. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted or error-free, or that a film will include any particular clip.
8. Limitation of Liability
To the maximum extent permitted by law, SignalRender Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the App after an update constitutes acceptance of the revised Terms.
